Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the caretotruck software platform, including the web application, mobile application, and all related APIs and services (collectively, the “Service”), operated by caretotruck (“we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Description of Service

caretotruck is a software preparation tool designed to help independent trucking owner-operators organize financial records, prepare cost-per-mile estimates, track fuel purchases for IFTA reporting purposes, estimate quarterly federal income tax obligations, log pre-trip inspections, and manage per-diem records.

caretotruck is not a tax preparer, tax advisor, CPA, accountant, attorney, or financial advisor. The Service does not file tax returns, IFTA returns, or any government documents on your behalf. All outputs — including tax estimates, IFTA prep packs, cost-per-mile calculations, and Schedule C summaries — are estimates for informational and organizational purposes only. You are solely responsible for the accuracy of your filings and for consulting a qualified professional before submitting any government return.

2. Eligibility

You must be at least 18 years old and legally authorized to operate a commercial vehicle or manage a trucking business in the United States. By using the Service, you represent that you meet these requirements.

3. Account Registration

You must create an account to access the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at support@caretotruck.com if you suspect unauthorized access.

4. Subscription, Trial, and Billing

4.1 Free Trial

New accounts receive a 7-day free trial with full access to all features. No credit card is required to start the trial. At the end of the trial period, access to paid features is suspended until a subscription is activated.

4.2 Paid Plans

Paid subscriptions are billed monthly. Current plan pricing is displayed on the billing page within the Service. Prices may change with 30 days' advance notice sent to your registered email address.

4.3 Payment Processing

Payments are processed by Helcim Inc. By providing payment information you agree to Helcim's terms of service. caretotruck does not store full credit card numbers.

4.4 Cancellation and Refunds

You may cancel your subscription at any time from the billing page. Cancellation takes effect at the end of the current billing period; you retain access through that date. We do not provide prorated refunds for partial months. If you believe you were charged in error, contact support@caretotruck.com within 14 days of the charge.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Upload files containing malware, viruses, or any malicious code
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Share your account credentials with third parties not authorized to access your account
• Use automated means (bots, scrapers, crawlers) to access the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
• Attempt to gain unauthorized access to any other user's account or data

6. Your Data and Content

You retain ownership of all data, files, and content you upload to the Service (“User Content”), including receipts, trip records, inspection records, and documents. You grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you.

You are responsible for the accuracy and legality of your User Content. We do not verify the accuracy of data extracted via AI (OCR) or voice transcription — always review AI-extracted fields before relying on them for any filing or business decision.

7. AI-Powered Features

The Service uses Google Gemini AI to extract data from receipt images, rate confirmation documents, and voice recordings. AI extraction is imperfect. Extracted values — including merchant names, dates, dollar amounts, fuel gallons, and document dates — may be incorrect. You must review all AI-extracted data before using it for tax, IFTA, or any other purpose. caretotruck is not liable for errors introduced by AI extraction.

8. Intellectual Property

The Service, including its design, code, text, graphics, and all underlying technology, is owned by caretotruck and protected by intellectual property laws. These Terms do not grant you any ownership interest in the Service. Feedback you provide about the Service may be used by us without restriction or compensation.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. TAX AND IFTA CALCULATIONS ARE ESTIMATES ONLY AND MAY NOT REFLECT YOUR ACTUAL TAX LIABILITY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARETOTRUCK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless caretotruck and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment of subscription fees, or for any other reason with reasonable notice. You may delete your account at any time by contacting support@caretotruck.com. Upon termination, your right to access the Service ends; we will retain your data for 30 days before deletion, during which time you may request an export.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property claims. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by sending an email to your registered address and by displaying a notice within the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the updated Terms.
